 egnorant gets 25 cents out of the $1.50, since that is the difference in mileage after the delivery fee began. If your store's mileage did not rise in synch, you got nothing out of the delivery charge. 100% went to the store. The mileage rose for other reasons. The skycap case appears very similar to the delivery charge issue. I for one will keep my eyes open. I never knew you could sue your company over lost tips.

 Sounds exactly like the delivery charge... "Skycaps complained in the lawsuit that many passengers saw the fee as a forced tip and therefore didn't tip them for handling their bags". Well then the delivery charge on a pizza delivery is also a forced tip, samething, different industry...If they can win the verdict so can pizza drivers around the country abolishing the "delivery charge." I am just surprised there hasn't been one yet filed against the big 3 & other pizza corporations around this country using the "delivery charge"...I'd say it could be an easy win... This "delivery charge" is existing on barrowed time as I see it today's sue happy world...Its good to go anytime soon... The 'delivery charge" either abolished altogether, or make it the law that no food establishment can have a delivery charge unless the WHOLE amount go to the driver... Once that is achieved the drivers are on a level playing field...

I'm surprised too. Even when the law is already on their side, some people are still reluctant to stand up for their rights. Go figure!

 Wow, some of these guys' income fell by 60%. A note of caution: One of the plaintiffs who worked in Missouri didn't get a dime. Apparently the successful skycaps were all from Massachusetts, and it was a Mass. state law that made their case. For those who are not from a state that has similar laws on the books, don't get too excited. http://www.mass.gov/legis/laws/mgl/149-152a.htm The airline will, of course, appeal. But I have to think that they will continue to charge the $2, only this time they will make sure there is a clear disclaimer. You can actually see the tiny print "Gratuity not included" in this photo:

I wonder if this is from the aftermath of the lawsuit, or if further changes will have be made to the signs. It will remain to be seen if customers will start tipping again, knowing that the $2 is not going to the skycaps... cause I doubt the $2 charge is going away.

Almost as easy a win as a guy living in Cali getting vehicle reimbursement.

Kinda like business owners in Cali who pay zero mileage reimbursement.

Yeah, and then maybe make a law requiring business owners to reimburse drivers for use of their vehicles.

Right. I don't really expect customers to either. It's the employer's fault. Everybody has their issues these days and while I've put out the word in the local paper, my issue is still with my employer. I don't expect customers to care about my every little problem on the job. They simply want pizza delivered. I simply want fair pay and a fair tip. That is all. Anything that causes confusion or interferes with tips is ridiculous.

 If you took away drivers' tips, their income would fall about 50%. I know my income declined because of the delivery charge. You could make an argument that the DC explains all those mysterious low ball tips and we all know the tip ought to be 15%. We have many customers who ask, at the door or on the phone, if there's a delivery charge. If it was a state law that made their case, let's start with pizza drivers in Massachusetts. Kim, you want to take a stab at this? There must be plenty of drivers in Mass out there. Then, we can find the other states with a similar law. Since it's a bit early to make any changes, I suspect the photo was taken prior to the lawsuit. The tiny disclaimer does not mean a thing. They will have to abolish the curbside bag checking fee.
